Can du’ā be made for a Muslim named deceased person without knowing his Muslim identity?

If we read in the news or somewhere else that so and so person has died and their name is that of a Muslim’s name, is that enough of proof for us to do du’aa for them?

Take for example if there was a name in a newspaper like “Yahya ibn Ahmad” announcing their death – With that do we assume they died as Muslims or do we need evidence before we do du’aa for them?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, it is permissible to make du’ā for such a deceased person who has a sign of being a Muslim yet it cannot be established whether he is a Muslim or not. A person bearing a Muslim name is generally a sign of him being Muslim. Hence, it will be permissible to make du’ā for such a person.[1]

وَلَوْ وُجِدَ مَيِّتٌ أَوْ قَتِيلٌ فِي دَارِ الْإِسْلَامِ فَإِنْ كَانَ عَلَيْهِ سِيمَا الْمُسْلِمِينَ يُغَسَّلُ وَيُصَلَّى عَلَيْهِ وَيُدْفَنُ فِي مَقَابِرِ الْمُسْلِمِينَ، وَهَذَا ظَاهِرٌ، وَإِنْ لَمْ يَكُنْ مَعَهُ سِيمَا الْمُسْلِمِينَ فَفِيهِ رِوَايَتَانِ، وَالصَّحِيحُ أَنَّهُ يُغَسَّلُ وَيُصَلَّى عَلَيْهِ وَيُدْفَنُ فِي مَقَابِرِ الْمُسْلِمِينَ لِحُصُولِ غَلَبَةِ الظَّنِّ بِكَوْنِهِ مُسْلِمًا بِدَلَالَةِ الْمَكَانِ، وَهِيَ دَارُ الْإِسْلَامِ، وَلَوْ وُجِدَ فِي دَارِ الْحَرْبِ فَإِنْ كَانَ مَعَهُ سِيمَا الْمُسْلِمِينَ يُغَسَّلُ وَيُصَلَّى عَلَيْهِ وَيُدْفَنُ فِي مَقَابِرِ الْمُسْلِمِينَ بِالْإِجْمَاعِ، وَإِنْ لَمْ يَكُنْ مَعَهُ سِيمَا الْمُسْلِمِينَ فَفِيهِ رِوَايَتَانِ، وَالصَّحِيحُ أَنَّهُ لَا يُغَسَّلُ وَلَا يُصَلَّى عَلَيْهِ وَلَا يُدْفَنُ فِي مَقَابِرِ الْمُسْلِمِينَ، وَالْحَاصِلُ أَنَّهُ لَا يُشْتَرَطُ الْجَمْعُ بَيْنَ السِّيمَا وَدَلِيلِ الْمَكَانِ، بَلْ يُعْمَلُ بِالسِّيمَا وَحْدَهُ بِالْإِجْمَاعِ، وَهَلْ يُعْمَلُ بِدَلِيلِ الْمَكَانِ وَحْدَهُ؟ فِيهِ رِوَايَتَانِ، وَالصَّحِيحُ أَنَّهُ يُعْمَلُ بِهِ لِحُصُولِ غَلَبَةِ الظَّنِّ عِنْدَهُ.

(قَالَ) وَإِذَا وُجِدَ مَيِّتٌ لَا يُدْرَى أَمُسْلِمٌ هُوَ أَمْ كَافِرٌ فَإِنْ كَانَ فِي قَرْيَةٍ مِنْ قُرَى أَهْلِ الْإِسْلَامِ فَالظَّاهِرُ أَنَّهُ مُسْلِمٌ فَيُغَسَّلُ وَيُصَلَّى عَلَيْهِ وَإِنْ كَانَ فِي قَرْيَةٍ مِنْ قُرَى أَهْلِ الشِّرْكِ فَالظَّاهِرُ أَنَّهُ مِنْهُمْ فَلَا يُصَلَّى عَلَيْهِ إلَّا أَنْ يَكُونَ عَلَيْهِ سِيمَا الْمُسْلِمِينَ فَحِينَئِذٍ يُغَسَّلُ وَيُصَلَّى عَلَيْهِ وَسِيمَا الْمُسْلِمِينَ الْخِتَانُ وَالْخِضَابُ وَلَيْسَ السَّوَادُ وَمَا تَعَذَّرَ الْوُقُوفُ عَلَى حَقِيقَتِهِ يُعْتَبَرُ فِيهِ الْعَلَامَةُ وَالسِّيمَا قَالَ اللَّهُ تَعَالَى {يُعْرَفُ الْمُجْرِمُونَ بِسِيمَاهُمْ} [الرحمن: 41] وَقَالَ {وَلَوْ أَرَادُوا الْخُرُوجَ لَأَعَدُّوا لَهُ عُدَّةً} [التوبة: 46]
