Do my parent’s have to get married again?

Answered as per Hanafi Fiqh by Askimam.org

Assalamu aleikum

My Mom accepted Islam at the begining of the year 2012 and my Father accepted Islam in September 2012. Now both of them are muslims, Alhamdulillah.

Do they have to remarry???? (they married 24 years ago under mexican law, both of them were christian-catholic)

Thanks!!!

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

We are pleased to note that your parent’s have accepted Islam. That is the greatest bounty of Allah (Subhanahu Wa Ta’ala) on them and on you. May Allah (Subhanahu Wa Ta’ala) keep all steadfast on Eemaan and grant all death in the state of Eemaan. Aameen.

In principle, when your mom accepted Islam in the beginning of 2012 and your dad did not accept Islam at that time, the marriage terminated upon three menstrual cycles. Now that your dad has accepted Islam, the marriage should be renewed according to the Shari’ah laws and principles of Matrimony (Nikaah). [1]

You may contact the local Imaam to perform the Nikaah.

And Allah Ta’āla Knows Best
