Is it permissible for me to go for Haj before I settle my debts?

I took a loan one year ago for a tenor of five years. With the loan amount, I bought a car and ran it for around eight months.  Recently I sold the car.  Can I go for Haj with the amount received from selling the car or do I have to settle my loan first?  Need to mention that I am solvent enough to continue my loan for the remaining periods.  I am eager to do Haj this year.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If you continue fulfilling the arrangement made with your creditor to pay your loan to him, it is permissible for you to perform your Haj this year. [1]

[1]  (قَوْلُهُ مِمَّنْ يَجِبُ اسْتِئْذَانُهُ) كَأَحَدِ أَبَوَيْهِ الْمُحْتَاجِ إلَى خِدْمَتِهِ وَالْأَجْدَادُ وَالْجَدَّاتُ كَالْأَبَوَيْنِ عِنْدَ فَقْدِهِمَا، وَكَذَا الْغَرِيمُ لِمَدْيُونٍ لَا مَالَ لَهُ يَقْضِي بِهِ، وَالْكَفِيلُ لَوْ بِالْإِذْنِ، فَيُكْرَهُ خُرُوجُهُ بِلَا إذْنِهِمْ كَمَا فِي الْفَتْحِ، وَظَاهِرُهُ أَنَّ الْكَرَاهَةَ تَحْرِيمِيَّةٌ وَلِذَا عَبَّرَ الشَّارِحُ بِالْوُجُوبِ، وَزَادَ فِي الْبَحْرِ عَنْ السَّيْرِ وَكَذَا إنْ كَرِهَتْ خُرُوجَهُ زَوْجَتُهُ وَمَنْ عَلَيْهِ نَفَقَتُهُ. اهـ. وَالظَّاهِرُ أَنَّ هَذَا إذَا لَمْ يَكُنْ لَهُ مَا يَدْفَعُهُ لِلنَّفَقَةِ فِي غَيْبَتِهِ قَالَ فِي الْبَحْرِ: وَهَذَا كُلُّهُ فِي حَجِّ الْفَرْضِ.(رد المحتار, ج 2, ص 456, سعيد)
