i heared a fatwa about “mortgage” is that in north america muslims can buy one house n one car on mortgage or lease,so i want to just verify this fatwa that can i buy a house on mortgage? N if not so what should  mulims do in north america because here is no option to buy a house without mortgage .so please solve my this confussion n give me a brief answer as soon as possible ,i m waiting for your response.

Assalaamu `alaykum waRahmatullahi Wabarakatuh

The most common method of buying a house in North America is by taking a mortgage from a bank. Taking a mortgage entails that one takes an interest bearing loan from the bank and gives the very house he is taking the loan for as collateral. If the individual falters in any of the payments or is unable to repay at all, then the bank has the right to foreclose the property. The fact that the person is required to take an interest bearing loan renders a mortgage impermissible in Islam. Allah Ta’ala has sternly forbade and warned against receiving or paying interest. A few of the verses that make mention of Riba are as follows:

 الَّذِينَ يَأْكُلُونَ الرِّبَا لاَ يَقُومُونَ إِلاَّ كَمَا يَقُومُ الَّذِي يَتَخَبَّطُهُ الشَّيْطَانُ مِنَ الْمَسِّ  ذَلِكَ بِأَنَّهُمْ قَالُواْ إِنَّمَا الْبَيْعُ مِثْلُ الرِّبَا وَأَحَلَّ اللَّهُ الْبَيْعَ وَحَرَّمَ الرِّبَا فَمَن جَاءَهُ مَوْعِظَةٌ مِّن رَّبِّهِ فَانتَهَىَ فَلَهُ مَا سَلَفَ وَأَمْرُهُ إِلَى اللَّهِ وَمَنْ عَادَ فَأُوْلَئِكَ أَصْحَابُ النَّارِ هُمْ فِيهَا خَالِدُونَ.(البقرة: 275)

Those who eat Riba (usury)will not stand (on the Day of Judgment) except like the standing of person beaten by Shaitan leading him to insanity. That is because they say: “Trading is only like Riba (usury),” whereas Allah has permitted trading and forbidden Riba. So whosoever receives an admonition from his Lord and stops eating Riba shall not be punished for the past; his case is for Allah (to judge); but whoever returns (to Riba), such are the dwellers of the Fire they will abide therein.(Qur’an 2: 275)

يَمْحَقُ اللَّهُ الْرِّبَا وَيُرْبِي الصَّدَقَاتِ وَاللَّهُ لاَ يُحِبُّ كُلَّ كَفَّارٍ أَثِيمٍ.(البقرة: 276)

Allah will destroy Riba (usury) and will give increase for Sadaqat (deeds of charity, alms, etc.) And Allah likes not the disbeleivers, sinners.(Qur’an 2: 276)

يَا أَيُّهَا الَّذِينَ آمَنُواْ اتَّقُواْ اللَّهَ وَذَرُواْ مَا بَقِيَ مِنَ الرِّبَا إِن كُنتُم مُّؤْمِنِينَ.(البقرة: 278)

O you who believe! Be afraid of Allah and give up what remains (due to you) from Riba (usury), if you are believers!(Qur’an 2: 278)

 

يَا أَيُّهَا الَّذِينَ آمَنُواْ لاَ تَأْكُلُواْ الرِّبَا أَضْعَافًا مُّضَاعَفَةً وَاتَّقُواْ اللَّهَ لَعَلَّكُمْ تُفْلِحُونَ.(آل عمران: 130)

O you who believe! Eat not Riba (usury) doubled and multiplied, but fear Allah that you may be successful.(Qur’an 3: 130)

In the above mentioned Ayaat Allah Ta’ala is strongly forbidding the believers from taking Riba and is informing about the outcome of those who deal with Riba. Many Ahadith of the Prophet (SallAllahu Alayhi Wasallam) have also made mention of the harms and severity of one that involves himself in Riba based transactions. A few Ahadith showing the severity of dealing with Riba are as follows:

   عن جابر قال لعن رسول الله صلى الله عليه وسلم آكل الربا ومؤكله وكاتبه وشاهديه وقال هم سواء.
(صحيح مسلم، 2/27، رشيديه)

The Prophet (SallAllahu Alayhi Wasallam) has cursed those who are involved in usury; whether it is by receiving it, giving it, recording it in writing, or witnessing to it.(Muslim)  

عن أبي هريرة أن رسول الله صلى الله عليه وسلم قال اجتنبوا السبع الموبقات قيل يا رسول الله وما هن قال الشرك بالله والسحر وقتل النفس التي حرم الله إلا بالحق وأكل الربا وأكل مال اليتيم والتولي يوم الزحف وقذف المحصنات الغافلات المؤمنات.(سنن أبي داود، 2/ 41، سعيد)

The Prophet (SallAllahu Alayhi Wasallam) has said: “Refrain from seven destructive sins.” It was asked, “Oh Messenger of Allah, what are they.” The Prophet (SallAllahu Alayhi Wasallam) replied, “Associating partners to Allah, magic, killing unless it is whom is deserving, taking usury, taking wealth of an orphan, runaway from the battlefield, to falsely accuse chaste innocent women.”(Abu Dawood) 

عن عبد الله بن حنظلة غسيل الملائكة قال قال رسول الله صلى الله عليه و سلم : درهم ربا يأكله الرجل وهو يعلم أشد من ستة وثلاثين زنية.(سنن الدار قطني،  2/ 11، الفكر)  

The Prophet (SallAllahu Alayhi Wasallam) has said: “If a person has knowingly taken one dirham as usury, indeed it is worse than committing adultery thirty-six times.”(al-Daar al-Qutni)

 عن أبي هريرة أن رسول الله صلى الله عليه وسلم قال ليأتين على الناس زمان لا يبقى أحد إلا أكل الربا فإن لم يأكله أصابه من بخاره. (سنن أبي داود، 2/ 117، سعيد)

The Prophet (SallAllahu Alayhi Wasallam) has said: “Surely a time will come when no person will remain, except that he is involved in usury. If one is not directly involved, than he is affected from its fumes.”(Abu Dawood)    

Again, the above mentioned ahadith warn about how devastating it is for one to be involved with usury in anyway. If a person is unable to purchase a house, he could rent a house. However, if that is not feasible, than one may seek out an Islamic financial institution that does not deal with usury.

( قوله كل قرض جر نفعا حرام ) أي إذا كان مشروطا كما علم مما نقله عن البحر ، وعن الخلاصة وفي الذخيرة وإن لم يكن النفع مشروطا في القرض ، فعلى قول الكرخي لا بأس به ويأتي تمامه.
