 Please find attached Fiqh us-Sunnah-pg 56- Who has the most right to be Imam. One Brother in our Masjid (Islamic Society of Grater Lowell, MA, USA) gave this page to me. I want to know since these document does not count  beard, sunnah dress, head covering, Please give me an comprehensive answer considering all  aspect of requirement.  So that I can give that to that brother. And If possible with proof from  Quran and sunnah

FYI In our masjid some Arab brother & other knows more Quran, most of them have very little bear or clean shave, usually don’t wear sunnah dress, wear half shirt, no cap, some  of them don’t follow any particular madhab, wipe over regular socks— etc  lead our congregational prayer.

Assalaamu `alaykum waRahmatullahi Wabarakatuh

Islām places great importance on Muslim men to perform salāh in congregation.  As an encouragement, each salāh prayed in congregation exceeds a salāh prayed individually by twenty-seven times.

حدثنا عبد الله بن يوسف قال أخبرنا مالك عن نافع عن عبد الله بن عمر أن رسول الله صلى الله عليه و سلم قال صلاة الجماعة تفضل صلاة الفذ بسبع وعشرين درجة

(صحيح البخاري، كتاب الجماعة والإمامة، باب وجوب صلاة الجماعة: 1/231؛ ابن كثير)

The Prophet صلى الله عليه وسلم said, “Prayer in congregation is greater than an individual prayer by twenty seven times” (Bukhārī)

Furthermore, as an admonition for those who miss congregational prayer without a valid excuse, the Prophet صلى الله عليه وسلم said,

أخبرنا أبو عبد الله الحافظ أنبأ أبو بكر إسماعيل بن محمد الفقيه بالري ثنا محمد بن الفرج الأزرق ثنا يحيى بن إسحاق ثنا سليمان بن داود اليمامي عن يحيى بن أبي كثير عن أبي سلمة عن أبي هريرة أن رسول الله صلى الله عليه و سلم قال لا صلاة لجار المسجد إلا في المسجد

(سنن البيهقي الكبرى، جماع أبواب فضل الجماعة والعذر بتركها، باب ما جاء من التشديد في ترك الجماعة من غير عذر: 3/57؛ الباز)

There is no prayer for the neighbor of the Masjid, except in the Masjid (Bayhaqī)

Hence, the Sharī’ah has encouraged communities to choose an imām who attracts people to come to the Masjid, as opposed to discouraging them.  With this principle in mind, the fuqahā’ (jurists) have understood the ahādīth on this topic and listed an order of preference for whom the communities should appoint as an imām.   A few qualities in a person that give him preference as an imām over others include:

1.       Having the most knowledge of the rules of prayer (as long as avoids sinning openly)

2.       Being the best in recitation of the Qur’ān according to the rules of tajwīd

3.       Having the most religiosity and piety

4.       Being the eldest in age

5.       Having the best etiquettes

These are all qualities in an imām that people desire in their imām and, thus, motivate them to come for the congregational prayer.  On the other hand, if the qualities of the imām are such that it displeases people, then, in turn, the people will become less motivated to come and pray behind him.  Hence, it is essential that the imām possesses qualities that bring people towards the congregation, as opposed to turning them away.

The qualities of the imāms you have mentioned in the query, such as clean-shaven or trimmed beards, no cap, and wiping over regular socks, contradict the third quality listed above (i.e. having the most religiosity and piety) and turn people away from the congregation.  Such imāms do not offer a service to the community by leading them in prayer.  Rather, they disservice the community by turning people away from the Masjid.  This contradicts the spirit of the Sharī’ah which aims to bring people towards the Masjid, not drive them away from it.

Hence, the community should appoint an imām who is a practicing ‘ālim, so that he possesses the qualities listed above.  

الأولى بالتقديم الأعلم بالسنة إذا كان يحسن من القراءة ما تجوز به الصلاة لأن القراءة يحتاج إليها في ركن واحد والعلم يحتاج إليها من أول الصلاة إلى آخرهاوإذا تساووا فأكثرهم قرآنافإن تساووا فأبينهم ورعافإن كانوا سواء فأكبرهم سناوالعالم بالسنة أولى بالتقديم إذا كان يجتنب الفواحش الظاهرة وإن كان غيره أورع منه

والأصل فيه ما روي عن أبي مسعود الأنصاري رضي الله عنه عن النبي صلى الله عليه وسلم أنه قال ليؤم القوم اقرؤهم لكتاب الله فإن كانوا سواء فأعلمهم بالسنة فإن كانوا سواء فأقدمهم هجرة فإن كانوا سواء فأكبرهم سنا فإن كانوا سواء فأحسنهم خلقا فإن كانوا سواء فأصبحهم وجهاوالأصح أن الأعلم بالسنة إذا كان يحسن من القراءة ما تجوز به الصلاة فهو أولىحتى قالوا إن الأعلم إذا كان ممن يجتنب الفواحش الظاهرة والأقرأ أورع منه فالأعلم أولى إلا أن النبي صلى الله عليه وسلم قدم الأقرأ في الحديث لأن الأقرأ في ذلك الزمان كان أعلم لتلقيهم القرآن بمعانيه وأحكامه

 فأما في زماننا فقد يكون الرجل ماهرا في القرآن ولا حظ له من العلم فكان الأعلم أولى فإن استووا في العلم فأورعهم لأن الحاجة بعد العلم والقراءة بقدر ما يتعلق به الجواز إلى الورع أشدفإن استووا في القراءة فأكبرهم سنافإن كانوا فيه سواء فأحسنهم خلقا

فالأعلم أحق بالإمامة ثم الأقرأ ثم الأورع ثم الأسن ثم الأحسن خلقا ثم الأحسن وجها ثم الأشرف نسبا ثم الأحسن صوتا ثم الأنظف ثوبا فان استووا يقرع أو الخيار للقوم

الأولى بالإمامة أعلمهم بأحكام الصلاةهذا إذا علم من القراءة قدر ما تقوم به سنة القراءةولم يطعن في دينهويجتنب الفواحش الظاهرة وإن كان غيره أورع منه كذا في المحيط وهكذا في الزاهدي وإن كان متبحرا في علم الصلاة لكن لم يكن له حظ في غيره من العلوم فهو أولى كذا في الخلاصة فإن تساووا فأقرؤهم أي أعلمهم بعلم القراءة يقف في موضع الوقف ويصل في موضع الوصل ونحو ذلك من التشديد والتخفيف وغيرهما كذا في الكفاية فإن تساووا فأورعهم فإن تساووا فأسنهم كذا في الهداية فإن كانوا سواء في السن فأحسنهم خلقا فإن كانوا سواء فأحسبهم فإن كانوا سواء فأصبحهم وجها كذا في فتح القدير أي أكثرهم صلاة بالليل كذا في الكافي فإن استووا في الحسن فأشرفهم نسبا كذا في فتح القدير فكل من كان أكمل فهو أفضل لأن المقصود كثرة الجماعة ورغبة الناس فيه أكثر كذا في التبيين فإن اجتمعت هذه الخصال في رجلين يقرع بينهما أو الخيار إلى القوم كذا في الخلاصة

( والأحق بالإمامة ) تقديما بل نصبا مجمع الأنهر ( الأعلم بأحكام الصلاة ) فقط صحة وفسادا بشرط اجتنابه للفواحش الظاهرة وحفظه قدر فرض وقيل واجب وقيل سنة ( ثم الأحسن تلاوة ) وتجويدا ( للقراءة ثم الأورع ) أي الأكثر اتقاء للشبهات والتقوى اتقاء المحرمات ( ثم الأسن ) أي الأقدم إسلاما فيقدم شاب على شيخ أسلم وقالوا يقدم الأقدم ورعا وفي النهر عن الزاد وعليه يقاس سائر الخصال فيقال يقدم أقدمهم علما ونحوه وحينئذ فقلما يحتاج للقرعة ( ثم الأحسن خلقا ) بالضم ألفة بالناس ( ثم الأحسن وجها ) أي أكثرهم تهجدا زاد في الزاد ثم أصبحهم أي أسمحهم وجها ثم أكثرهم حسبا ( ثم الأشرف نسبا ) زاد في البرهان ثم الأحسن صوتا وفي الأشباه قبيل ثمن المثل ثم الأحسن زوجة ثم الأكثر مالا ثم الأكثر جاها ثم الأنظف ثوبا ثم الأكبر رأسا والأصغر عضوا ثم المقيم على المسافر ثم الحر الأصلي على العتيق ثم المتيمم عن حدث على المتيمم عن جنابة
