In Fatwa # 14362 from Bangladesh, you said: “There are two situations with the Sunnat of Fajr • If you read the Sunnat you will be able to join the congregation • If you read the Sunnat Salaah you will not be able to join the congregation In the first situation it is necessary to perform the Sunnat Salaah and then join the Jama’ah. However, if you are confident that if you will perform the Sunnat Salaah, you will miss the Jama’ah, then leave the Sunnat and join the congregation…” However, please note this Hadith in Sahih Muslim: Muslim :: Book 4 : Hadith 1531 Abu Huraira reported the Apostle of Allah (may peace be upon him) as saying: When the prayer commences then there is no prayer (valid), but the obligatory prayer. This hadith has been narrated by Warqa’ with the same chain of transmitters. Can you please explain your Fatwa in light of the above Hadith? Assalamualaikum

Assalaamu `alaykum waRahmatullahi Wabarakatuh

It is important to realize that any Hadith cannot be taken on face value, even though it might be saheeh. There are many factors which could affect the status of practicing on any Hadith. Our illustrious Fuqaha رحمهم الله تعالى have made painstaking efforts in sifting out and clarifying for us which Ahadith should be used and which should be left out. Not every Hadith is ma’mool bih (practiced upon).

The famous Tabi’e Ibrahim Nakh’i رحمه الله تعالى mentioned:

“Verily I listen to Ahadith, then I sift them and see which are suitable to be practiced on, and I leave the rest.”

The great muhaddith, Abdur Rahman Mahdi رحمه الله تعالىused to say:

“A person cannot become an Imam unless he knows which Ahadith are saheeh and which are not and until he does not take proof from every Hadith.”

Imam Abdullah bin Wahb رحمه الله تعالى used to say:

“I studied many Ahadith from 160 ulama, but had it not been for Imam Malik and Layth ibn Sa’d رحمهما الله تعالى I should have been led astray. On being questioned as to why would have he been led astray he replied: I gathered many Ahadith but I was left confused so I used to show these narrations to Malik and Layth ibn Sa’d رحمهما الله تعالى and they used to show me which narrations I should take and which I should leave.”

The great stalwart of Hadith, Imam Sufyan Thawri رحمه الله تعالى said:

“Understanding Ahadith is better than merely listening to it.”

Abu Ali al-Nisaburi رحمه الله تعالى said:

“Understanding Ahadith is more important to us than memorizing it.”

Ibn Uqda رحمه الله تعالى said:

“Narrate less Ahadith for Ahadith is not appropriate except for those who know the ta’weel (interpretation) of them.”

Ibn Wahb رحمه الله تعالى narrates that he heard Imam Malik رحمه الله تعالى say:

“Many Ahadith could be a means of misguidance.”

Ibn Abi Zayd al-Qayrawani رحمه الله تعالى quotes ibn U’yayna رحمه الله تعالى as saying:

“Hadith is a means of been led astray except for the Fuqaha”

Imam Tirmidhi رحمه الله تعالى mentions:

“The Fuqaha understand the meaning of Ahadith the best.”

Abu Nu’aym al-Fadhl ibn Dukayn رحمه الله تعالى, the ustadh of Imam Bukhari رحمه الله تعالى, mentions:

“I used to pass by Imam Zufar رحمه الله تعالى (student of Imam Abu Hanifa رحمه الله تعالى) whilst he was sitting wrapped up in a sheet. He used to call me saying o the squint eyed one! come here so that I may sift your Ahadith for you. I should show him my Ahadith upon which he should comment: this you could take and this you should leave; this is the abrogater and this is the abrogated.”

If all the above mentioned muhaddithoon, who were mountains of knowledge, were still in need of the Fuqaha, then how can people like us distant ourselves from the Fuqaha? Our illustrious Fuqaha spend their lives in understanding the Noble Quran and Ahadith. They only passed rulings after having studied the different Ahadith, seeing which are suitable for practice and which are not. Not every narration is suitable for practice. A narration could be abrogated, there could be other Ahadith on the topic too, the Hadith could be going against other principles of Islam (despite the fact that it is saheeh. An example of this is found in Saheeh Muslim). Our illustrious Fuqaha only passed a verdict after taking into consideration all the different aspects related to any Hadith. They had the whole picture in front of them. Only after much thought and debate did they pass any verdict.

How unfortunate it is that we find some people today, who haven’t even understood the basics of Islam, open some English translation of Hadith books and think that they have reach the seventh heaven. They think that they are now fit enough to derive laws themselves and become their own Imams and mujtahids. This is indeed a very sad state of affairs. ? It is indeed a pity that regarding our worldly affairs we only want the best, but when it comes to matters of religion we are so relaxed. This shows what regard we have for the Deen of Allah Ta’ala. This is playing with the pure Deen of Allah Ta’ala. May Allah Ta’ala protect us all. Ameen.

Below we shall have a look at some of the proofs which allows a person to perform the sunnahs of Fajr after the commencement of iqama.

First Proof

حدثنا إسحاق بن إبراهيم عن عبد الرزاق عن الثوري عن أبي إسحاق عن عبد الله بن أبي موسى قال : جاء ابن مسعود والامام يصلي الصبح فصلى ركعتين إلى سارية ولم يكن صلى ركعتي الفجر

ورجاله موثقون مجمع الزوائد (1/172) (اعلاء السنن 7/101 علمية)

Abdullah ibn Abi Moosa narrates:

Ibn Masood رضي الله تعالى عنه came and the Imam was in the Fajr prayer. He performed the sunnah prayer behind a pillar and then joint the Imam. (I’la al-sunan 7/101)

 2037 – حدثنا سليمان بن شعيب قال ثنا عبد الرحمن بن زياد قال ثنا زهير بن معاوية عن أبي إسحاق قال حدثني عبد الله بن أبى موسى عن أبيه : حين دعاهم سعيد بن العاص دعا أبا موسى وحذيفة وعبد الله بن مسعود رضي الله عنهم قبل أن يصلى الغداة ثم خرجوا من عنده وقد أقيمت الصلاة فجلس عبد الله الى أسطوانة من المسجد فصلى الركعتين ثم دخل في الصلاة فهذا عبد الله قد فعل هذا ومعه حذيفة وأبو موسى لا ينكران ذلك عليه فدل ذلك على موافقتهما إياه

Abdullah ibn Abi Masood رضي الله تعالى عنه narrates from his father:

When Sa’eed ibn al-As called them he also called Abu Moosa, Hudhayfa, and Abudullah ibn Masood رضي الله تعالى عنهم before the Fajr prayers. When they left from him the salah already begun. Abdullah ibn Masood performed two rak’ahs behind a pillar and then joined the Imam. (Sharh Ma’ani al-Athar 1/255)

Sayyiduna Abdullah ibn Masood رضي الله تعالى عنه performed this prayer in the presence of Sayyiduna Abu Moosa and Sayyiduna Hudhayfa رضي الله تعالى عنهماand they did not object to his action. This shows that they agreed with him.

Sayiduna Abu Mijlaz رضي الله تعالى عنه narrates:

I entered the masjid for Fajr salah with Ibn Umar and Ibn Abbasرضي الله تعالى عنهما. Ibn Umar رضي الله تعالى عنه entered the saff and joined the congregation whilst Ibn Abbas رضي الله تعالى عنه first performed two rak’ahs and then joined the prayer. After salah Ibn Umar رضي الله تعالى عنهsat in his place until sunrise and thereafter he performed two rak’ahs. (Sharh Ma’ani al-Athar 1/255)

Muhammad ibn Ka’b narrates:

رواه الطحاوي ورجاله ثقات الا ان يحيى بن ابي كثير يدلس آثار السنن(2/32)، قلت عداده في مرتبة الثانية وهي من احتمل الائمة تدليسه، وأخرجوا له في الصحيح لامامته وقلة تدليسه، كما في طبقات المدليسن (2/11) فالحديث صحيح الاسناد (اعلاء السنن 7/105 علمية)

Abu Uthman al-Nahdi relates:

When we used to find Umar رضي الله تعالى عنهstarted the Fajr and we had not as yet performed our salah, we used to perform two rak’ahs in the back of the masjid and then join the salah. (I’la al-sunan 7/107) (Sharh Ma’ani al-Athar 1/256)

عن الحارث عن علي قال: – كان النبي صلى الله عليه و سلم يصلي الركعتين عند الإقامة

فيه الحارث ضعفه بعضهم ووثقه آخرون وهو حسن الحديث كما مر غير مرة وبقية رجاله ثقات

Sayyiduna Ali رضي الله تعالى عنه reports:

Nabi صلى الله عليه و سلمused to perform two rak’ahs  at the time of iqamah. (I’la al-sunan 7/108)

Hasan رحمه الله تعالىused to say:

If you enter the masjid and you did not pray the sunnah of Fajr then perform it in the corner of the masjid even though the Imam has started the prayer and thereafter join the prayer. (I’la al-sunan 7/108) (Sharh Ma’ani al-Athar 1/256)

280 – وحدثني عن مالك عن يحيى بن سعيد أنه قال :كان عبادة بن الصامت يؤم قوما فخرج يوما إلى الصبح فأقام المؤذن صلاة الصبح فأسكته عبادة حتى أوتر ثم صلى بهم الصبح

ورجاله ثقات الا ان فيه انقطاع يحيى بن سعيد لم يسمع من صحابي غير انس كذا في التهذيب (11/423)

 281 – وحدثني عن مالك عن عبد الرحمن بن القاسم أنه قال سمعت عبد الله بن عامر بن ربيعة يقول :إني لأوتر وأنا أسمع الإقامة أو بعد الفجر يشك عبد الرحمن أي ذلك قال

وسنده صحيح وعبد الله بن عامر ولد في عهد النبي صلى الله عليه وسلم ورآه وهو غلام كما في التهذيب (5/271)

Proofs of those who say one should not perform the sunnah salah when the iqamah is given

First Proof

ومنه ما رواه مسلم بطريق ورقاء و زكريا بن اسحق و ايوب كلهم عن عمرو بن دينار عن عطاء بن يسار عن أبي هريرة عن النبي صلى الله عليه وسلم انه قال إذا أقيمت الصلاة فلا صلاة إلا المكتوبة

Sayyiduna Abu Hurayrah رضي الله تعالى عنه reports that Nabi صلى الله عليه وسلم said:

When the iqamah is called out, then there is no salah except the fardh salah. (I’la al-sunan 7/111)

وكان من الحجة لهم على أهل المقالة الأولى أن ذلك الحديث الذي احتجوا به أصله عن أبى هريرة رضي الله عنه لا عن النبي صلى الله عليه و سلم هكذا رواه الحفاظ عن عمرو بن دينار

1.      Scholars differ as to whether this hadith is from Nabi صلى الله عليه وسلم or is it from Sayyiduna Abu Hurayrah رضي الله تعالى عنه. This hadith is narrated through Amr ibn Dinar رحمه الله تعالى. Ibn U’yayna رحمه الله تعالى, who is the ahfadh (one with the best memory) from the students of Ibn Dinar narrated it as mawqoof. Therefore, whether we go by the manhaj (procedure) of Muhadditheen or by those who give tarjeeh through qara’in or by the view of those who give preference to the narration of the one who is ahfadh in all these cases preference will be given to the narration of Ibn U’yayna رحمه الله تعالى, which is mawqoof.

If we take the manhaj of the Fuqaha and some Muhadditheen that preference will go to the marfoo’ narration, then we find this narration to be in contrast to the narration wherein Nabi صلى الله عليه وسلم commands:

عن أبي هريرة قال قال رسول الله صلى الله عليه وسلم لا تدعوهما وإن طردتكم الخيل سنن أبى داود

Do not leave them (the sunnah of fajr) even if you are trampled upon by horses. (Abu Dawood)

Therefore, when there are two contradicting narrations we will combine these narrations if possible. And also when there are two contradicting narrations we will consider the opinions of other Sahaba رضي الله تعالى عنهم. Some of these narrations have been mentioned above.

2.      This narration is not general.  In other narrations we find that Nabi صلى الله عليه وسلم also used to perform two rak’ahs at the time of iqamah. So when this narration is made khas (specific), we could use the narration of Abu Dawood added with the practice of Sahaba رضي الله تعالى عنهم to exclude the sunnah’s of Fajr from this ruling.

3.      Furthermore, the laws of shariah are all based on ta’leel (cause). The illah for this ruling is that the fardh salah should not be confusedmixed up with nafl prayers and a person should not be doing something contrary to the Iman. This reasoning is deduced from the narration of Malik ibn Buhayna (which follows). This illah is also evidently found in the other narrations quoted by those who say salah cannot be performed. Some of these narrations follow below. When the illah is not found the karahah will also not be found.

 2026 – حدثنا فهد قال ثنا أبو صالح قال حدثني الليث عن عبد الله بن عياش بن عباس القتباني عن أبيه عن أبى سلمة عن أبى هريرة رضي الله عنه عن رسول الله صلى الله عليه و سلم قال : إذا أقيمت الصلاة فلا صلاة الا التي أقيمت لها فقد يجوز أن يكون أراد بهذا النهى عن أن يصلى غيرها في موطنها الذي يصلى فيه فيكون مصليها قد وصلها بتطوع فيكون النهى من أجل ذلك لا من أجل أن يصلى في آخر المسجد ثم يتنحى الذي يصليها من ذلك المكان فيخالط الصفوف ويدخل في الفريضة

Imam Tahawi رحمه الله تعالى mentions the illah to be joining between two salahs. He also quotes many narrations to proof his point. (Sharh Ma’ani al-Athar 1/254)

 2030 – فإذا إبراهيم بن مرزوق قد حدثنا قال ثنا هارون بن إسماعيل قال ثنا على بن المبارك قال ثنا يحيى بن أبى كثير عن محمد بن عبد الرحمن : أن رسول الله صلى الله عليه و سلم مر بعبد الله بن مالك بن بحينة وهو منتصب أي قائم يصلى ثمة بين يدي نداء الصبح فقال لا تجعلوا هذه الصلاة كصلاة قبل الظهر وبعدها واجعلوا بينهما فصلا

4.      The prohibition in the narration of Sayyiduna Anas رضي الله تعالى عنه narrated by Ibn Khuzayma is muqayyad (conditional) for one who performs salah in the masjid. This clearly gives permission to perform salah out of the masjid and dalalatan (indicates) permissions of performing salah in the masjid away from the jama’ah.

وعند ابن خزيمة عن أنس خرج النبي حين أقيمت الصلاة فرأى ناسا يصلون ركعتين بالعجلة فقال صلاتان معا فنهى أن تصليا في المسجد إذا أقيمت الصلاة

Second Proof

 2027 – حدثنا علي بن معبد قال ثنا يونس بن محمد قال ثنا حماد عن سعد بن إبراهيم عن حفص بن عاصم عن مالك بن بحينة أنه قال : أقيمت صلاة الفجر فأتى رسول الله صلى الله عليه و سلم على رجل يصلى ركعتي الفجر فقام عليه ولاث به الناس فقال أتصليها أربعا ثلاث مرات

Malik Ibn Buhaynaعنه رضي الله تعالىnarrates:

The iqamah was called out. Nabi صلى الله عليه و سلم approached a person who was performing the two rak’ahs of Fajr.  (After Nabi صلى الله عليه وسلم left) the Sahaba surrounded him and asked him what did Nabi صلى الله عليه وسلمtell him. He replied that Nabi صلى الله عليه وسلم said: are you praying four rak’ahs of Fajr? Nabi صلى الله عليه وسلم asked this thrice. (Sharh Ma’ani al-Athar 1/254)

It is possible the Nabi صلى الله عليه وسلم disapproved him praying sunnah and fardh in the same place. This is clear in the following narration:

شرح معاني الآثار – الطحاوي – (1 / 254)

 2030 – فإذا إبراهيم بن مرزوق قد حدثنا قال ثنا هارون بن إسماعيل قال ثنا على بن المبارك قال ثنا يحيى بن أبى كثير عن محمد بن عبد الرحمن : أن رسول الله صلى الله عليه و سلم مر بعبد الله بن مالك بن بحينة وهو منتصب أي قائم يصلى ثمة بين يدي نداء الصبح فقال لا تجعلوا هذه الصلاة كصلاة قبل الظهر وبعدها واجعلوا بينهما فصلا

Muhammad Ibn Abdur Rahman narrates:

Nabi صلى الله عليه وسلمpassed by Malik Ibn Buhayna رضي الله تعالى عنهand he was standing performing salah during the iqamah. Nabi صلى الله عليه وسلمtold him: do not make this salah like the prayer before andafter Zuhr. Separate between this salah. (Sharh Ma’ani al-Athar 1/254)

This narration is mentioned muttasilan in Musnad Ahmad. (I’la al-sunan 7/120)

Thereafter, Imam Tahawi رحمه الله تعالى mentions other Ahadith in which Nabi صلى الله عليه وسلم disapproved of not separating between the fardh and sunnah salah.

Third Proof:

 2034 – حدثنا ربيع المؤذن قال ثنا أسد قال ثنا حماد بن سلمة وحماد بن زيد عن عاصم الأحول عن عبد الله بن سرجس : أن رجلا جاء ورسول الله صلى الله عليه و سلم في صلاة الصبح فركع ركعتين في حديث حماد بن سلمة خلف الناس ثم دخل مع النبي صلى الله عليه و سلم في الصلاة فلما قضى النبي صلى الله عليه و سلم صلاته قال يا فلان أجعلت صلاتك التي صليت معنا أو التي صليت وحدك

Sayyiduna Abdullah Ibn Sarjis رضي الله تعالى عنه narrates:

Whilst Raulullah صلى الله عليه وسلم was performing the Fajr prayer, a person came and performed two rak’ah’s of salah behind the sufuf and then entered with Nabi صلى الله عليه وسلم. After the prayer Nabi صلى الله عليه وسلم asked him: which prayer did you consider as your prayer, the one you performed alone or the one who performed with us? (Sharh Ma’ani al-Athar 1/255)

Answer:

 أنه قد يجوز أن يكون قوله كان خلف الناس أي كان خلف صفوفهم لا فصل بينه وبينهم فكان شبيه المخالط لهم فذلك أيضا داخل في معنى ما بان من حديث بن بحينة وهذا مكروه عندنا وانما يجب أن يصليهما في مؤخر المسجد ثم يمشى من ذلك المكان الى أول المسجد فأما أن يصليهما مخالطا لمن يصلى الفريضة فلا

This person performed salah behind the Imam but it was together with the sufuf. This is makrooh according to us also. If the person comes late he should perform his salah away from the congregation. (Sharh Ma’ani al-Athar 1/255)

 

Fourth Proof

اعلاء السنن (7/120)

فمنه ما اخرجه البيهقي عن أبي هريرة ، قال قال رسول الله صلى الله عليه وسلم قال : « إذا أقيمت الصلاة فلا صلاة إلا المكتوبة » قيل يا رسول الله ولا ركعتي الفجر؟قال و لاركعتي الفجر. وقال الحافظ في الفتح وزاد مسلم بن خالد عن عمرو بن دينار في هذا الحديث قيل يا رسول الله ولا ركعتي الفجر قال ولا ركعتي الفجر أخرجه بن عدي في ترجمة يحيى بن نصر بن الحاجب وإسناده حسن

It is narrated from Sayyiduna Abu Hurayrah رضي الله تعالى عنه that Rasulullah صلى الله عليه وسلمsaid:

When the iqamah is called out then there is no salah except the fardh salah.” Rasulullah صلى الله عليه وسلم was asked: “and not even the two rakah’s before Fajr?” Nabi صلى الله عليه وسلم replied: “and not even the the two rakah’s before Fajr.

Hafidh Ibn Hajar رحمه الله تعالى graded this chain as hasan. (I’la al-sunan 7/120)

قلت: مسلم بن خالد و يحيى بن نصر فيهما مقال، ويحيى اسواهما حالا…… وذكر ابن عدي هذا الحديث في مناكير يحيى بن نصر وقال رواه جماعة عن عمرو (ابن دينار) ولا اعلم احدا زاد فيه قيل يا رسول الله الخ الا يحيى بن نصر عن مسلم عنه كما في اللسان ايضا. فان سلمنا انه حسن الحديث كما زعمه الحافظ فلا نسلم هذه الزيادة التي تفرد بها عن مسلم بن خالد عن الشذوذ

Two narrators of this chain are mutakallam fih, Muslim ibn Khalid and Yahya ibn Nasr. Many have narrated this Hadith but none besides Yahya ibn Nasr narrated this addition: “Rasulullah صلى الله عليه وسلم was asked: “and not even the two rakah’s before Fajr?” Nabi صلى الله عليه وسلم replied: “and not even the the two rakah’s before Fajr”. Even if we accept this narration to be hasan we cannot accept this extra portion.

وايضا: يعارضه ما رواه البيهقي من طريق حجاج بن نصير، عن عباد بن كثير، عن ليث، عن عطاء، عن ابي هريرة ان رسول الله صلى الله عليه وسلم قال: إذا أقيمت الصلاة فلا صلاة إلا المكتوبة الا ركعتي الصبح. كذا في عون المعبود (1/479). وقال البيهقي: هذه الزيادة لا اصل لها، و حجاج بن نصير وعباد بن كثير ضعيفان. انتهى

This narration also contradicts another narration which states:

“Except the two rakah’s of Fajr”.

Imam Bayhaqi رحمه الله تعالى mentions that this extra portion (“Except the two rak’ahs of Fajr”) has no basis.

قلت نعم! لكن حجاج بن نصير احسن حالا من يحيى بن نصير بن حاجب….. ولا أعلم له شيئا منكرا غير ما ذكرت وهو في غير ما ذكرته صالح…..

واما عباد بن كثير وان كان مختلفا فيه فليس دون مسلم بن خالد…..

فهذا الاسناد ايضا حسن بل هو احسن مما رواه يحيى بن نصر عن مسلم بن خالد لوجهين، الاول لكون حجاج بن نصير من رجال الصحاح دون يحيى، و الثاني لتصريح ابن عدي انه لم يعلم لحجاج شيئا منكرا سوى ما ذكر من رواياته الثلاث عن شعبة، وهو في غير ما ذكره صالح، ولجزم الذهبي بانه لم يات بمتن منكر، ولم يذكر ابن عدي ولا الذهبي حديث الا ركعتي الصبح في مناكيره بخلاف ما رواه يحيى بن نصر عن مسلم، فقد صرح ابن عدي بانه قد تفرد بالزيادة التي فيه، وعده من مناكيره

Yes it could be that it has no basis, however, let us examine the sanad of this narration and the narration it contradicts. We find that Hajjaj ibn Nasir is of a greater status than Yahya ibn Nasir. Abbad ibn Khatir although he is mukhtalaf fih but he is not less in status than Muslim ibn Khalid. The sanad of this narration is also hasan and it is better than the chain of the previous narration.

Therefore, this sanad is better than the one of the previous narration for two reasons:

1.      Hajjaj ibn Nasir is a narrator of the Sihah in contrast to Yahya.

2.      Ibn Adi رحمه الله تعالى clearly mentioned that besides the three narrations from Shu’ba he is unaware of any other munkar narration from Hajjaj. This narration is not found to be from amongst those three munkar narrations. Dhahabi رحمه الله تعالى also mentions that Hajjaj did not narrate any munkar narration. This is in contrast to the narration from Yahya as Ibn Adi رحمه الله تعالى has clearly mentioned that this is the tafarrud from Yahya and his from amongst his manakeer.
