In question 2 if a person is not making a statement to actually divorce but just EXPLAINING about his grief to his parents, in which he says ‘I have already divorced her twice’

This is to clarify Fatwa # 15988,

Jazakallah brother MI. Ehzaz Ajmeri, for the reply. In question 2 if a person is not making a statement to actually divorce but just EXPLAINING about his grief to his parents, in which he says ‘I have already divorced her twice’, speaking in sort of a past tense, then does 2 divorces still take effect?

Also for talaaq to take effect the TOGUE MUST MOVE?, regardless whether one actually says ‘I divorce you three times’ in ones mind?

Assalaamu `alaykum waRahmatullahi Wabarakatoh

If a person states that he has already divorced his wife twice in which he actually had not, two talaq will occur.  If he had given her two talaqs and is only informing the parents about it, a new talaq will not occur.

أن من أقر بطلاق سابق يكون ذلك إيقاعا منه في الحال ؛ لأن من ضرورة الاستناد الوقوع في الحال ، وهو مالك للإيقاع غير مالك للإسناد (المبسوط)

ولو أقر بالطلاق كاذبا أو هازلا وقع قضاء لا ديانة… كما لو أقر بالطلاق هازلا أو كاذبا فقال في البحر ، وإن مراده لعدم الوقوع في المشبه به عدمه ديانة ، ثم نقل عن البزازية والقنية لو أراد به الخبر عن الماضي كذبا لا يقع ديانة ، وإن أشهد قبل ذلك لا يقع قضاء أيضا .

The opinion of majority of the scholars is that talaq will only be effective when the words of talaq are spoken so loud that the speaker himself or the person next to the speaker is able to hear them clearly. On the other hand, if one only mumbles or whispers the words of talaq, and the person next to him cannot hear the words of talaq clearly, then talaq will not be effective.  Talaq also does not take effect by merely thinking about talaq without utterance.
