Can the biological father of a girl born through an illegitimate relationship travel with her as her mahram?

With regards to a girl born through an illegitimate relationship, the biological father is not recognised as the father in Shariah, however he is amongst her mahaarim.
Will he be treated as the general mahaarim in relation to seclusion and travel etc, or are there restrictions in terms of their interaction? 

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is correct that her biological father is her mahram even though the daughter was born from an illegitimate relationship. However, the jurists [fuqaha] have emphasized that the daughter should not travel with him. This is the more cautious view and further from arousing suspicion. [i]

قوله ومع زوج أو محرم) هذا وقوله ومع عدم عدة عليها شرطان مختصان بالمرأة فلذا قال لامرأة وما قبلهما من) [i]

 الشروط مشترك والمحرم من لا يجوز له مناكحتها على التأبيد بقرابة أو رضاع أو صهرية كما في التحفة وأدخل في الظهيرية بنت موطوءته من الزنا حيث يكون محرما لها، وفيه دليل على ثبوتها بالوطء الحرام، وبما تثبت به حرمة المصاهرة كذا في الخانية نهر
لكن قال في شرح اللباب ذكر قوام الدين شارح الهداية أنه إذا كان محرما بالزنا فلا تسافر معه عند بعضهم، وإليه ذهب القدوري وبه نأخذ اهـ وهو الأحوط في الدين والأبعد عن التهمة. اهـ
