Can I please get some clarification as to the permissability of taweez/amulet

Answered as per Hanafi Fiqh by Askimam.org

Can I please get some clarification as to the permissability of taweez/amulet, many sources say that taweez is impermissible however I am confused as to if its permissible or not.

Can you please provide evidence from the Quran/aHadith for clarification please.

May I request that i can be emailed with a response on m.smalik@hotmail.co.uk because on previous occasions I have not had a reply.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is permissible to use ta’weez on condition it does not contain words of Kufr and shirk. If a ta’weez contains the names or qualities of Allah or words of dua and one uses it with the belief that the ta’weez is a mere means of cure like medication and does not believe the ta’weez to be the actual cause of ones cure, then it is permissible to use the ta’weez. Consider the following

Amr Bin Shuaib relates from his grandfather that Nabi ﷺ  said

Jami` at-Tirmidhi 3528

When one of you becomes frightened during sleep, then let him say: ‘I seek refuge in Allah’s Perfect Words from His anger, His punishment, and the evil of His creatures, from the whisperings of the Shayatin, and that they should come (A`ūdhu bikalimātillāhit-tāmmati min ghaḍabihī wa `iqābihī wa sharri `ibādih, wa min hamazātish-shayāṭīni wa an yaḥḍurūn).’ For verily, they shall not harm him.” He said: “So `Abdullah bin `Amr used to teach it to those of his children who attained maturity, and those of them who did not, he would write it on a sheet and then hang it around his neck.

The prohibition of ta’weez with the conditions as explained as above is deduced from the following narration

Uqba Bin Aamir Al Juhany narrates that a group of people came to Rasul ﷺ   so he accepted a pledge of allegiance from nine of them and did not accept it from one, so they said oh prophet of Allah you accepted the pledge of allegiance from nine but left this one, so he replied surely he is wearing a Tameema, so the individual then took hold of the Tameema and broke it off. After doing so the prophet ﷺ accepted the pledge of allegiance from him and said who ever wears a Tameema surely has done shirk.

In the explanation of the word Tameema Imam Baihaqi rah says

“ The Tameema is known as a kharaza and is a  necklace which the Arabs would tie around their necks believing that it averts calamities. It is possible, that the prohibition and detestability of wearing a Tameema is for that person who believes that, the restoration of health and the removal of illness is through the Tameema as the people of Jahiliyya would believe. As for that person who wears it taking Barakah through the name of Allah and knowing that the calamity cannot be lifted except by Allah and cannot be removed except by Allah, then there is no harm in him wearing this necklace.”
